Terms and Conditions

Definitions

In these Terms and Conditions, the following terms shall have the following meanings:

Services

All services offered by NetSalon, including the Platform.

User / Partner

Any natural or legal person with whom NetSalon enters into a legal relationship, including users of the Trial Account.

Agreement

Any agreement between the Parties regarding the provision of Services.

Party / Parties

User, Partner, and/or NetSalon.

Platform

The Software-as-a-Service (SaaS) services that NetSalon offers via the internet.

Fee

The amounts owed by the Partner to NetSalon based on the Agreement.

Applicability

  1. These Terms and Conditions apply to all Agreements.
  2. The Agreement is concluded through online registration on the website or apps of NetSalon.
  3. In the case of an Agreement for an indefinite period, it may be terminated by either Party with a notice period of at least one (1) month.

Trial Account

NetSalon offers a free trial version of the SaaS Services (Trial Account) for a period of at least twelve (12) months. After the trial period, NetSalon may delete User data without warning, unless an Agreement has been concluded in a timely manner.

Services

After concluding the Agreement, NetSalon will start providing the Services on an 'as is' basis. The User is responsible for the use of the Services and the consequences thereof. The User must comply with all applicable laws and regulations. NetSalon may modify or suspend the Services, with reasonable notice.

Fee & Payment

The Partner is periodically obliged to pay a Fee according to the rates set by NetSalon. Payment must be made within thirty (30) days after the invoice date via our payment processor Stripe. NetSalon may adjust rates annually and will inform the Partner in a timely manner.

Obligations of User and/or Partner

The User and/or Partner ensures that the provided data is correct and is responsible for securing access to the NetSalon environment. The User and/or Partner indemnifies NetSalon against claims from third parties arising from the use of the Services.

Obligations of NetSalon

NetSalon will provide qualified personnel and strives for continuous availability of the Services, but cannot guarantee uninterrupted operation. In the event of prolonged unavailability, the User and/or Partner has no right to compensation or claims for damages.

Confidentiality & Personal Data

The Parties shall not disclose confidential information to third parties without consent. Personal data will be processed in accordance with the Data Processing Agreement.

Intellectual Property

The User remains the owner of their data. NetSalon owns all intellectual property rights to the Services and Platform. The User is granted a non-transferable right of use for the duration of the Agreement.

Liability

NetSalon is not liable for damages due to unavailability or defects in the Services, including but not limited to indirect damage, consequential damage, lost profits, or damage due to business interruption.

Communication

The User and/or Partner agrees that NetSalon may contact them to provide information about offers, promotions, and surveys related to the Services. The User and/or Partner has the right to unsubscribe from such communication at any time by sending a request to contact@netsalon.nl.

Termination

  1. NetSalon reserves the right to cease the provision of its Services at any time. In that case, NetSalon will notify the User, c.q. Partner, at least three (3) months in advance. After termination of the Agreement, the provisions that are intended to remain in effect after termination shall remain in force, including at least the provisions in the articles on confidentiality, intellectual property, and liability.

  2. NetSalon has the right to block an account if there is abuse of the Services. This may include, but is not limited to, unauthorized use, failure to meet payment obligations, violation of the Terms and Conditions, or other behaviors that are harmful to NetSalon or other users.

Final Provisions

NetSalon may amend these Terms and Conditions and will communicate changes in a timely manner. The most recent changes can always be found on the current webpage.
